HB 1574 to enable people to seek medical help for overdoses without risk of a drug possession or usage arrest has advanced to the Senate after a 56-41 vote in the House.
The bill also enables healthcare facilities, including hospitals, to distribute syringes and drug smoking equipment, but has been amended from an earlier version which had a greater capacity to override local laws.
AWC appreciates that the amended version of the bill eliminates the potential to preempt local governments’ ability to limit drug paraphernalia distribution.

HB 1574 to expand existing immunity from drug prosecutions under medical-related circumstances preempts cities.
The bill, sponsored by Rep. Nicole Macri (D–Seattle), would enlarge protection from drug possession arrests and prosecutions for a person seeking medical help for a drug overdose to also prohibit property seizures and arrests for violating other court orders. The protections would cover the person needing assistance as well as any person seeking help for them.
Additionally, the bill would enable health care facilities, including hospitals, to distribute drug paraphernalia, including syringes and smoking equipment. Health care facility staff would be legally able to use drug-testing equipment to analyze samples of substances.
AWC’s concerns about this bill include its removal of cities’ and counties’ authority to regulate harm reduction services concerning drug paraphernalia.
