The Department of Commerce (Commerce) is preparing to review and update the administrative rules for the Growth Management Act (GMA). Commerce is considering changes based on new legislation, case law, and the need to clarify statutory requirements that
the existing rules do not adequately address.
The administrative rules under consideration include:
- Chapter 365-190 WAC, Minimum Guidelines to Classify Agricultural, Forest and Mineral Lands and Critical Areas;
- Chapter 365-195 WAC, Best Available Science; and
- Chapter 365-196 WAC, Procedural Criteria for Adopting Comprehensive Plans and Development Regulations.
Commerce will initiate a separate rulemaking process to address housing issues, including those in HB 1220, and allow for more focused
outreach on housing and equity.
Commerce worked with several state agencies to develop the draft scope of potential changes. Over the summer, Commerce will work with local governments and tribes to refine the scope. Commerce is now accepting public comments on the draft scope through August 13. Send written comments to: gmarulemaking@commerce.wa.gov.
The draft scope provides additional details on the project background and the decision-making criteria for potential changes. Commerce will begin releasing recommended changes to the Washington Administrative Code (WAC) later this year and anticipates
holding a public hearing next spring.
