New terminology for “competency to stand trial” under consideration

HB 2152, sponsored by Rep. My-Linh Thai (D–Bellevue) updates terminology in laws relating to criminal insanity and competency to stand trial.

Terminology in current law like “competency to stand trial” and “capacity” would be changed to “ability to proceed to trial” and “present ability”.

The bill is intended to change the terminology, not the meaning of the law, and reduce stigma. The bill raises significant practical issues, however, and AWC testified with concerns. Please reach out to Lindsey Hueer with comments on this legislation.
