SB 5876, sponsored by Sens. Short (R–Addy) and Nguyen (D–Seattle), exempts “essential services” from state and local noise regulations. Essential
services are defined as “the provision, repair, or delivery of utility, telecommunications, food, water, or sanity services.”
AWC has several concerns with the bill, as introduced. Cities would be prohibited from enforcing ordinances previously adopted that were meant to mitigate noise pollution from activities such as construction, grocery store deliveries, and the installation
and repair of utility services. It should be noted that under current law, cities have the authority to set different standards, allowing for higher dBA levels and extended hours.
