Blake decision causes cities to reevaluate municipal codes

AWC recently became aware of a potential issue with how some cities adopted specific parts of their municipal codes. As you may be aware, the recent Blake decision requires county prosecutors to take a close look at each impacted individual’s criminal history. Depending on how your city adopted state statutes for prosecution in municipal courts, certain municipal court convictions could be invalid. Please review this checklist to determine if your city has an issue. If you determine there is a problem with your code, please contact your county prosecutor to address your concerns.
