HB 1212 passed out of committee with one change and the Senate companion version is up for a hearing. SB 5509 is sponsored by Sen. Emily Alvarado (D–Seattle).
The substitute version of HB 1212 changed the implementation timeline to the following:
- Cities planning under the Growth Management Act that are required to update their comprehensive plan in 2027 must include the bill’s provisions, if passed, and
- All other cities must implement two years after the bill's effective date

Proposal to require cities to authorize childcare centers in more areas

Rep. Emily Alvarado (D–Seattle) has introduced a straightforward proposal regarding city zoning for childcare facilities. We appreciate that Rep. Alvarado reached out to AWC to get feedback on this proposal before session. AWC has been increasingly hearing from members about needs in their community for additional childcare access.
HB 1212 addresses one barrier—the frequent use of conditional use permitting. This practice can introduce additional cost and uncertainty to an already low margin business.
HB 1212 would do the following:
- Cities and towns must allow childcare centers, and the conversion of existing buildings for use as childcare centers, as an outright permitted use in all zones except industrial zones.
- Cities may impose reasonable restrictions on the permit, including pickup and drop-off areas.
- Cities must adopt or amend by ordinance, and incorporate into their development regulations, zoning regulations, and other official controls, the requirements no later than:
- One year after their next Growth Management Act (GMA) periodic comprehensive plan update, or
- Within one year of the effective date of the bill if not a GMA planning city or town
