The Office of Independent Investigations will conduct investigations into the use of force by law enforcement officers.
HB 1267, sponsored by Reps. Debra Enteman (D–Kent) and David Hackney (D–Seattle), establishes the Office of Independent Investigations
(OII) within the Office of the Governor. The OII is considered an investigative law enforcement agency tasked with investigating serious use of force incidents and any criminal act by a law enforcement officer that merited filing criminal charges.
By July 1, 2022, the Office is authorized to begin investigating cases involving the use of deadly force occurring after July 1, 2022. Beginning July 1, 2023, the OII can begin investigating cases involving in-custody deaths and sexual assaults committed
by an officer. Additionally, beginning July 2023, the Office may investigate the use of deadly force by an officer if new evidence is brought forward. The statute of limitations for investigating cases is three years.
Law enforcement agencies are required to contact the OII if an incident involves the use of deadly force by an officer that results in death or bodily harm. Once the Office begins an investigation, information regarding the investigations will only be
shared in limited briefings with the chief of police. In cases where the OII declines to investigate an incident involving deadly force, the responsibility of investigating falls to the local law enforcement agency.
The OII is also tasked with analyzing data regarding the use of deadly force and publishing an annual report.
