Non-federal testing

Your organization may have drug-free workplace policies and procedures for employees who are not subject to the federal testing requirements. The D&A Consortium can help you in meeting these employer policies. Tests offered include:

  • Pre-employment
  • Reasonable suspicion
  • Post-accident
  • Return to duty/follow-up testing

If your agency is a member of the D&A Consortium and has employees in the FMCSA, FTA, or PHMSA random pools, there is no additional membership fee to utilize our services for non-federal employees. Testing services


You have the option of testing your employees under a standard 5-panel of drugs (replicating drug panel testing per U.S. DOT regulations) or a panel of 10 drugs. There is no cost difference in opting for the higher panel of testing; however, your drug and alcohol testing policy and procedures need to specify the drugs being tested.

 

Pre-employment testing


The Court of Appeals has held that suspicionless urine testing of government workers is permissible only in very limited situations, such as where the job involves tasks that might create a genuine risk to public safety.

The appeals court decision also limits pre-employment urine testing to sworn police officers, firefighters, and positions requiring an employee to carry a firearm. Note: The municipality can use less intrusive measures, such as conducting thorough background checks of prospective employees, in order to determine whether someone will be able to perform on the job to screen applicants.

 

Payment and billing


If your agency is a member of the D&A Consortium and has employees in the FMCSA, FTA, or PHMSA random pools, there is no additional membership fee to utilize our services for non-federal employees. You will be billed directly by PROCOM for any non-federal tests.

If your agency is only utilizing D&A Consortium services for non-federal employees, your agency will be charged a small annual fee. You will then be billed directly by PROCOM for any non-federal tests.

Forms


In order to conduct a non-federal test, non-federal/non-DOT forms must be used. Federal testing forms cannot be used for this purpose. Contact your AWC staff if you need a Chain of Custody form.
