At AWC’s Member Expo in Chelan, Sean Oswald spoke about Navigating “non-negative” drug/alcohol test results and Monitoring drug & alcohol test site compliance. Here are six things Sean wants to make sure you know.
- Non-negative does not equal positive: Refusal to test, adulterated, or substituted specimens all fall under the umbrella of "non-negative" and are treated the same as a positive result.
- Immediate action is required: CDL drivers with non-negative results should be temporarily removed from safety-sensitive duties until next steps are confirmed.
- Return-to-duty process applies: Unless otherwise determined by the MRO, drivers with non-negative results would be subject to DOT-mandated SAP process before resuming safety-sensitive work.
- Know when to report: Employers must report verified positive results, refusals, and other violations to Clearinghouse within the required timeframes.
- Educate supervisors: Ensure all supervisors are trained in reasonable suspicion, including recognizing signs of substance abuse. Thanks Sean! Have you signed your supervisors up for our supervisor trainings? Space is limited!
