When it comes to an employee driving their personal vehicle while on duty and gets into an accident, there are several things to keep in mind:
- The employee’s personal automobile policy is primary. Meaning, they would need to file a claim through their carrier for damage to their own vehicle, as RMSA’s policy does not cover auto physical damage to an employee’s personal vehicle.
- The employee would also be expected to file a claim through their own carrier for third-party damage or injury. In the event the third-party damages exceed their personal auto policy limits, then a member’s RMSA coverage would kick in.
- It’s important to note that many personal auto policies exclude “business use”. In the event that happens, the member could choose to tender the matter to RMSA for handling – this is for third-party damages only.
- Lastly, in situations where employees are allowed to use their personal vehicle for work, we recommend requesting the employee provide the city with proof of auto insurance on the vehicle they will be operating for city business.
