ADU self-certification bill passes Legislature

With the goal to accelerate accessory dwelling unit (ADU) permitting and, thus, construction, HB 1353 creates an optional pathway for cities under the Growth Management Act (GMA).

The bill, sponsored by Rep. Alex Ramel (D–Bellingham), unanimously passed the Senate and heads to the Governor’s desk for signature. For cities planning under the GMA, HB 1353 provides an option to create self-certification programs for the construction or development of detached ADUs on residential properties. The program allows for registered architects to self-certify compliance with applicable building code requirements for the construction of one or more ADUs. After a city reviews the permit application for completeness, it may determine the application in compliance with building code requirements without further review.

For cities choosing this option, HB 1353 also set out program requirements that cities must follow. Importantly, the bill does not impact any ADU self-certification programs already in place.
