Washington Supreme Court leaves clarification of police liability exception in place

While it is rare that we report on the Washington Supreme Court not taking up a case, we want to make sure cities are aware of the decision by the Court on November 5 to decline review of Zorchenko v. Federal Way, 31 Wn. App. 2d 390, 549 P.3d 743 (2024), leaving in place a helpful Court of Appeals precedent for cities on liability. That decision limited liability by clarifying an exception to the public duty doctrine related to the duty of care in responding to 911 calls.
