More information on State’s opioid settlement with distributors and how cities can receive a portion of funds

Contact: Candice Bock, Sheila Gall, Jacob Ewing

In May Attorney General Bob Ferguson announced a $518 million settlement with several major opioid distributors. To receive a portion of those funds, cities with a population over 10,000 will need to sign the participation form for the settlement agreement and submit it to the Attorney General’s Office (AG) by September 23, 2022. To help cities understand what this may mean and provide an opportunity to answer questions, AWC will host a webinar with the AG in early August.  Watch for an email soon with details.

The AG’s letter sent in June to cities with a population over 10,000 provided details on the settlement and outlined the requirements for cities to receive funds. Per the settlement agreement, 100% of litigating Washington cities and 90% of non-litigating cities with a population over 10,000 will need to agree to the settlement by executing and returning a participation form by September 23, 2022.

For more information about the agreement and how it relates to the Memorandum of Understanding (MOU) for a settlement agreement involving a collation of cities represented by Keller Rohrback see last month’s article.

Please note that AWC is facilitating the sharing of information between the Attorney General and cities. AWC is not part of the litigation and does not have a position on the pending litigation or the settlement offers. The information contained in these materials is for informational purposes and should not be considered legal advice. Each city will need to determine its own course of action in consultation with its legal counsel.
