Discrimination against tenants with pandemic rental arrears prohibited by new bill

Under a new bill, sponsored by Rep. Melanie Morgan (D–Parkland), a landlord would be prohibited from discriminating against a prospective tenant who did not pay rent during the COVID-19 moratorium.

HB 1441 forbids a landlord from the following actions based on unpaid rent during the pandemic-related eviction moratorium:

  • Refuse to lease or rent any real property to a prospective tenant.
  • Falsely represent that a dwelling unit is not available.
  • Make any distinction, discrimination, or restriction against a prospective tenant in the price, terms, conditions, fees, or privileges relating to the rental.
  • Attempt to discourage the rental to a prospective tenant.
  • Coerce another person to commit an act that violates these provisions.
  • Intimidate or otherwise interfere with a tenant who has sought the protections of these provisions.

A person in violation of these provisions would be civilly liable for up to four and one-half times the monthly rent of the property, as well as court costs and reasonable attorneys' fees.

HB 1441 has passed out of committee and awaits a floor vote in the House.
