A substitute version of SB 5163 passed out of committee and scheduled for a hearing. The substitute’s main substantive change is that claims can be tried by a judge or jury. HB 1135, also a substitute mirroring SB 5163, passed out of committee on Friday, February 1.

Both bills, as currently drafted, would significantly expand city tort liability associated with wrongful death claims.

AWC opposes this legislation.
