Favorable court decision on recreational immunity

The Washington Supreme Court ruled in favor of local governments in a case concerning the scope of the state’s recreational immunity statute.

The statute provides liability protection for owners of recreational land – which often includes city parks, trails, and other properties. On April 19, the court filed its decision in Lockner v. Pierce County, finding in the county’s favor. The court held that the statute provides protection even when a property is not for sole recreational use and that the immunity protection also extends to negligence actions.

AWC filed an amicus brief with Washington State Association of Municipal Attorneys and the Cascade Water Alliance.
