HB 1909, concerning the confidentiality of industrial insurance claim records, is scheduled for a public hearing. HB 1909 would require the Department of Labor and Industries (L&I) to investigate if an employer or employer agent has been reported for revealing a mental health condition or treatment information to any person other than an authorized representative. If it is determined that claim file information was revealed, a notice of assessment must be issued and the employer is subject to a civil penalty of $1,000 per occurrence.
