PRA demographic data exemption fails to advance

SB 6123 sought to exempt an agency employee ’s voluntarily submitted demographic data from inclusion in public records requests. The bill was not voted out of committee ahead of the cutoff deadline and is considered dead for this session.

 


 

PRA exemption for demographic data tied to personal identifying information

January 16, 2026

Sen. Steve Conway (D–Tacoma) and Pierce County are leading the push on SB 6123, which exempts an agency employee’s voluntarily submitted demographic data from inclusion in public records requests. “Personal demographic detail” is defined as self-identified race, ethnicity, sexual orientation, immigration status, national origin, or disability status. The bill does not prohibit the release of demographic data when personal identifying information is removed or if the data is produced in an aggregate format.

SB 6123 is scheduled for a hearing in the Senate State Government, Tribal Affairs, & Elections Committee on Friday, January 23, at 10:30 am.
