Unlawful firearm possession for violent offenders bill intends to address gun violence

HB 1139 seeks to increase criminal penalties for unlawful firearm possession. The bill would increase public safety by creating more serious consequences for individuals with a history of violent criminal behavior when they are found in unlawful possession of firearms.

Key provisions of the bill include:

  • Reclassified offenses: Certain cases of unlawful firearm possession are reclassified as violent offenses and impose stricter consequences.
  • Increased sentences: Makes adjustments to sentencing levels to ensure harsher penalties for repeat offenders and those with prior violent criminal histories.
  • Mandatory booking: Authorizes police officers to use probable cause to arrest and book individuals into jail if they are found unlawfully possessing a firearm.
  • Sentencing guidelines changes: Amends existing laws to align sentencing rules with enhanced penalties.

HB 1139 is scheduled for a public hearing in the House Community Safety Committee on Tuesday February 11 at 4 pm.
