The task force on B&O tax apportionment has completed its work and will submit a report to the Legislature by October 31, 2018.

The task force on B&O tax apportionment has completed its work and will submit a report to the Legislature by October 31, 2018. The task force’s report includes consensus recommended changes to the definition of customer location in the current apportionment formula in RCW 35.102.130. We expect that the recommendations may be introduced as legislation next session. If changes are adopted, it would require changes to the B&O tax model ordinance that cities would have to adopt late next year.

The task force created by EHB 2005 met monthly for more than a year to discuss changes to the definition of customer location from the current definition based on the location of in-person contacts with customers to one based on a hierarchy of commonly available business information.

AWC appreciates the work of the following task force members:

 • Joseph Cunha, Seattle
 • Danielle Larson, Tacoma
 • Chris Bothwell, Lake Forest Park

We also appreciated the input and review cities provided on the draft of the proposed changes.
